VICTORY!

On December 30, 2025, Charleston County Judge Dale Van Slambrook reversed and struck down the Board of Zoning Appeals’ (BZA) approval of the short-term rental (STR) at 1441 N. Edgewater Drive and remanded the matter back to the BZA for further proceedings. The Court found that the BZA acted on an incomplete application and committed errors of law, including approving the request without a proper site plan and disregarding evidence of noncompliance. As a result, the STR approval is no longer valid, and the applicant must start all over before the BZA pursuant the Court’s directives, among which are that that future STR applications must strictly comply with the zoning ordinance and be supported by complete and accurate evidence. We will continue to vigorously oppose any applications (STR or otherwise) that are inconsistent with our zoning and neighborhood character. More updates will follow as the remand process unfolds.  The “Homes Not Hotels” signs will go back up if or when it becomes necessary.  It should now be crystal clear to all that we have the will, the organization, and the resources to continue our fight against any STR in Edgewater Park.
